Lease Compliance Manager
SUMMARY
The purpose of this position is to manage and oversee all aspects of real estate lease compliance, which includes contractual co-tenancy requirements, waivers, consents, prohibited uses, reporting and tracking, as well as ensuring alignment with real estate, legal and store operations.
The position is responsible for delivering occupancy cost savings by identifying and managing lease compliance violations and leveraging the waiver and consent process to achieve more favorable lease terms and / or savings for the company.
This position is responsible for the overall integrity of all lease related information entered, imported and exported from the Store Lifecycle Management (SLM) database
SUPERVISORY RESPONSIBILITIES
Directly supervises the Lease Administration Coordinator and Invoice Processor positions in the Lease Administration department. Carries out supervisory responsibilities in accordance with the organization’s policies and applicable laws. Responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing work; appraising performance; addressing complaints and resolving problems.
ESSENTIAL DUTIES AND RESPONSIBILITIES
- Analyzes, verifies and authorizes contract and variable rent payments to our landlords.
- Administer and manage the lease compliance program to maximize occupancy cost savings.
- Manage and oversee all department compliance issues relative to Internal Audit, Segregation of Duties, and SOX. This individual is responsible for communicating any audit findings and opportunities for improvement to senior management.
- Must be able to read, interpret and analyze complex lease language to ensure all provisions of the Landlord / Tenant contractual lease obligations are met.
- Manage all opening and ongoing co-tenancy violations. Partner with Legal, Store Operations and Field Managers where appropriate to identify and validate lease violations and / or disputes.
- Leverage the waiver and consent process by negotiating with landlords to achieve more favorable lease terms and / or reduce occupancy expense.
- Track and report violations and associated cost savings, including accomplishments to senior leadership.
- Performs portfolio analysis for shopping center co-tenancy and prohibited use violations, including forecasting the potential savings.
- Ability to communicate in an effective, professional and efficient manner.
- Performs complex analysis by creating and analyzing ad hoc financial reports, providing timely accurate financial and operational information for upper management to review for direction on business decisions.
- Drive strategic process improvements through the development of applicable technology tools and system applications.
- Perform financial analyses, due diligence and seek approvals for potential process improvements.
- Must demonstrate advanced analytical and negotiating skills.
- Work directly with Finance, Lease Accounting, Legal, Construction, Facilities, Real Estate VP’s, Store Operations and the Property Management team on any lease compliance issues.
EDUCATION and/or EXPERIENCE
Bachelors’ degree in Finance, Business Administration, Real Estate, 5 to 10 years of related work experience in Commercial Real Estate or Financial Reporting. MBA strongly preferred.

This position is accountable for reducing occupancy costs through lease compliance.
SCOPE OF RESPONSIBILITY
Middle level of management. Typically manages a team and is responsible for an organization(s) performing work in one or more related functions or projects. Typically possesses 5 -10 years relevant professional work experience.
MAJOR CHALLENGES
Identify potential process to streamline the efforts of the lease compliance staff. Effectively navigate the team through change management. Drive consistency in lease compliance and dispute resolution. Negotiate complex deals with Landlords while adhering to critical timelines and dates. Develop and implement a robust Real Estate strategy to determine the appropriate practices in managing the growing portfolio of stores.
TECHNICAL SKILLS
- Advanced analytical and negotiating skills
- Advanced ability to read and interpret Lease language
- Advanced understanding of Microsoft Word and Excel
- Intermediate understanding of Microsoft PowerPoint
- Intermediate understanding of Microsoft Access
- Intermediate to Advanced knowledge of SLM/Lease Administration
